What Happens if Someone Gets Doored?

Riding a bike in the city doesn’t happen without its share of risks. While it’s a great way to get around, it can also be dangerous if everyone’s not as careful as the biker. Bicyclists have the same responsibility as motorists to signal when turning, stop at a red light, and follow other traffic laws, but many motorists don’t pay as much attention to bicyclists as they do to other motorists. If you were doored while legally riding down the street, there are some things you should know.

Drivers Should Be Checking for Bicyclists

Because bike lanes are often in such close proximity to cars that park on the side of the street, drivers should always check for bikers before opening the car door. Passengers in the parked car have the same responsibility. Because of this responsibility, fault for dooring a bicyclist is typically placed on the individual who opened the door.

There Are Some Instances When the Bicyclist Can Avoid Collision

In some instances, the driver of the car might argue the bicyclist had a chance to avoid the collision. For example, if it can be reasonably assumed the biker saw the driver park his or her car, and there was plenty of space on the road, the biker could have swerved around the car. In some cases, this might be a chance for the driver to share liability with the bicyclist, but that’s not always the case.

Being Doored Could Cause Serious Injuries

When someone gets doored, it can cause serious injuries. The speed at which the individual is cycling will play a large role in how severe the injuries are, but there are other aspects at play as well. For example, if the bicyclist is able to avoid the door by swerving, but is then hit by another oncoming car, the injuries could be far worse. Liability would typically fall with the individual who opened the door, but you may be able to seek compensation from both drivers.

Some common injuries that occur from being doored include broken bones, a damaged spine, a head injury and neck injuries. All of these are serious and all will typically require expensive medical care.
